Custody disputes can be part of a divorce, paternity or custody action, and involves two major areas, legal custody and physical custody.

 

Legal custody predominately involves the rights of parents to be involved in making medical, education and religious decisions on behalf of their children.

 

Whereas physical custody involves which household the minor children predominately live in.

 

When parents are unable to agree on the issues of custody, the courts are required to decide both legal and physical custody, which can result in the court ordering joint legal custody and joint physical custody; joint legal custody and sole physical custody; sole legal custody and sole physical custody or deciding legal custody only and adding a designation of "primary household".

 

It is extremely important to understand that the initial decisions regarding legal and physical custody can be very difficult to change after a judgment is entered with the court, because there are mandated legal thresholds that must be met in order to modify custody.

 

There are also situations where it is imperative to file motions to modify custody and/or motions to move to another State, which typically includes having to also modify parenting time.  In all of these situations, a highly skilled attorney can be extremely critical to proving the legal grounds to modify custody, modify parenting time and/or move to another State and secure a new court order that is in the best interest of you and your children.
